Telford funding solution launched

A Telford-based funding specialist has launched a new solution aimed at SMEs, making it more feasible for companies to fight for – and win – commercial disputes.​​

BMS Funding, a specialist in funding solutions for law firms, has developed this solution after recognising that many businesses don’t bring their commercial disputes forward for fear of losing the case, of it being too complex or spiralling financial costs.

Through close collaboration with leading regional law firms and insurance providers, BMS Funding has launched a solution where with just a £20,000 commitment from the company, BMS can provide all other financial expenditure in relation to the case. 

The company can then pursue the case in full knowledge that they will not need to write any further cheques if they lose the case, providing business owners with the support, backing and financial power to take on even the largest of businesses or most complex of cases, its CEO explained.

Paul Havenhand of BMS Funding (pictured), said: “Thousands of commercial litigation cases are brought forward each year in the £100,000 to £1m arena, but many of them never make it to court due to clients simply not having the capital or appetite for the financial risk to see them through.

“Unfortunately, that means that many cases which have the potential to win are dropped and lost in the ether, resulting in businesses losing out on getting justice or recovering their financial losses.

“The first barrier in any case is the provision and security of funds, which may the possible barriers this places on businesses at the very first step of the process. BMS have launched a solution which provides the financial backing for companies to take their case through to completion.

Commercial litigation funding has been the bastion of large, complex cases requiring tens of £millions in funding. The majority of commercial cases have a sub-£1 million funding requirements whereby litigants are expected to take the all the risk, pay all their money and hope for a good outcome.

“BMS have closely reviewed this sector and have worked with specialists in their respective fields to provide businesses with fully risk-manged solution, which ensures the companies’ financial exposure is limited to £20,000 in the event their case is lost."
